General conditions of sale
Object of the contract
These General Terms and Conditions apply to the remote purchase of products via the Internet from HDR Srl, via Papa Giovanni XXIII, 11 – 81014 Capriati a Volturno (CE) – VAT number 03256320619, owner of the website www.hdrcompany.com/shop. Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, with regard to privacy protection, will be subject to the provisions of Law no. 675/96 and subsequent amendments.
Acceptance of the general conditions of sale
The contract between HDR Srl and the Customer shall be deemed concluded upon acceptance of the order by HDR Srl. Such acceptance is deemed tacit. By placing an order through any of the available methods, the Customer declares having read all the information provided during the purchase process and fully accepts the general terms and conditions and payment terms set out below. If the Customer is a consumer (i.e., a natural person purchasing goods for purposes not related to their professional activity), once the purchase process has been completed, they will print or save an electronic copy and, in any case, retain these general terms and conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling and, with regard to the protection of confidentiality, will be subject to the provisions of Law no. 675/96 and subsequent amendments.
The Customer is excluded from any right to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.
How to purchase
The Customer may only purchase products listed on the website www.hdrcompany.com/shop. It is understood that the image accompanying the product description is purely illustrative and the actual product may differ from the published photo. All information supporting the purchase is intended as general information and does not refer to the actual characteristics of an individual product.
HDR Srl confirms receipt of the order by sending an email to the email address provided by the Customer. This confirmation message will contain an "Order Number," which must be used in all further communications with HDR Srl. The message will contain all the information entered by the Customer, who undertakes to verify its accuracy and promptly communicate any corrections, according to the procedures described in this document. In the event of non-acceptance of the order, HDR Srl guarantees prompt notification to the Customer. Right of withdrawal
Pursuant to Legislative Decree 206/2005, if the customer is a consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity, or who does not indicate a VAT number on the order form to HDR Srl), they have the right to withdraw from the purchase contract for any reason, without explanation and without penalty, except as indicated in the following paragraph. To exercise this right, the customer must send HDR Srl a notice to this effect within 14 working days of receiving the goods. This notice must be sent by registered letter with acknowledgement of receipt addressed to HDR Srl, Via Papa Giovanni XXIII, 11 – 81014 Capriati a Volturno (CE), or by telegram or fax sent within the aforementioned 14-day period to +39 0823 944738, followed by confirmation by registered letter with acknowledgement of receipt, MUST be sent within the following 48 hours. Once we receive the aforementioned notice of withdrawal, HDR Srl will promptly communicate to the customer the instructions on how to return the goods, which must reach HDR Srl within 14 days of authorization.
The right of withdrawal is however subject to the following conditions:
– the right applies to the product purchased in its entirety; it is not possible to exercise the right of withdrawal on only part of the product purchased;
– The purchased item must be intact and returned in its original packaging, complete in all its parts. Under no circumstances should labels or adhesive tape be attached directly to the product's original packaging.
– by law, the shipping costs for returning the goods are the responsibility of the customer;
– the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
– In the event of damage to the goods during transport, HDR Srl will notify the customer of the incident (within 5 working days of receiving the goods at its warehouse), allowing the customer to promptly file a complaint with the courier of their choice and obtain a refund for the value of the goods (if insured). In this case, the product will be made available for return, simultaneously canceling the request for withdrawal.
– HDR Srl is not responsible in any way for damage or theft/loss of goods returned via uninsured shipments;
Upon arrival at the warehouse, the product will be inspected for any damage or tampering not resulting from transport. If the packaging and/or original wrapping are damaged, HDR Srl will deduct a percentage of the refund due, no more than 10% of the refund, to cover repair costs. Except for any repair costs for confirmed damage to the original packaging, HDR Srl will refund the customer the amount already paid as quickly as possible and in any case within 30 days of the withdrawal request. This will be done by reversing the amount charged to the credit card or by bank transfer. In the latter case, the customer will be responsible for promptly providing the bank details for the refund (ABI – CAB – Current Account of the invoice holder).
The right of withdrawal lapses entirely, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where HDR Srl ascertains:
– the lack of the external packaging and/or the original internal packaging;
– damage to the product for reasons other than its transport.
In the event of forfeiture of the right of withdrawal, HDR Srl will return the purchased item to the sender, charging the latter the shipping costs.
Satisfaction or your money back guarantee
Products marked with the "satisfied or refunded" seal are covered by a special guarantee offered by HDR exclusively for its customers. If the customer who purchases the product is dissatisfied with the quality of the goods, within 30 working days of receiving the goods, they may return the original packaging, even empty, by mail to: HDR Srl, Via Papa Giovanni XXIII, 11 – 81014 Capriati a Volturno (CE). The guarantee is valid only for products ordered for the first time and not for reorders. If the return concerns multiple pieces of the same product, only one empty packaging may be used; the other products must be intact.
Force majeure
Neither Party may be held liable for the total or partial failure to fulfill its obligations under this Agreement if such failure is caused by a case of force majeure. Cases of force majeure shall be considered events that meet the criteria established by case law. The Party invoking a case of force majeure must notify the other Party within five business days of the occurrence or threat of such event. The Parties agree to reach an agreement as quickly as possible to jointly determine the modalities for executing the order during the duration of the case of force majeure.

The sales contract between the Customer and HDR Srl is deemed to have been concluded in Italy and is governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the relevant court of his/her municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Isernia.
